Customs Conference: “Delegation of Authority in Customs Matters” and “Shipper/RDE Relations” – June 9, 2021

 

On June 9, 2021, Gaspard de BELLESCIZE led a seminar for members of a professional business federation on the topic of delegations of authority in customs matters. This fascinating subject, at the intersection of criminal, civil, and labor law, allowed us to distinguish the conditions under which “customs powers of attorney,” “customs representation mandates,” and other “powers of attorney” constitute genuine “delegations of authority” that allow the delegator to avoid criminal liability for customs violations, which is “transferred” to one of their employees.

We also addressed the topic of the relationship between shippers and RDE, focusing on the contractual relationship and remedies available to the parties.
